Please read these terms and conditions carefully before engaging our services.

1. Acceptance of Terms

By engaging Elite Trade Management to perform any work or by accepting a quotation provided by us, you agree to be bound by these Terms and Conditions. These terms constitute the entire agreement between you (the "Client") and Elite Trade Management (ABN XX XXX XXX XXX) regarding the provision of services described herein. If you do not agree with any part of these terms, you must not proceed with engaging our services.

We reserve the right to amend these Terms and Conditions at any time. Any changes will be effective immediately upon posting to our website. It is your responsibility to review these terms periodically. Continued engagement of our services following any amendments constitutes your acceptance of the revised terms.

2. Services

Elite Trade Management is a trade management company providing a comprehensive range of building, renovation, and maintenance services across Australia. Our core service offerings include, but are not limited to, home renovations and remodelling, aged care home modifications (including works funded under the Commonwealth Home Support Programme and Home Care Packages), and commercial painting services for corporate and retail clients.

We act as the principal trade management contractor, coordinating all necessary trades, suppliers, and logistics to deliver your project from start to finish. The specific scope of work for each engagement will be detailed in the quotation or proposal provided to you prior to the commencement of any work.

All work performed by Elite Trade Management will be carried out in accordance with applicable Australian Standards, the National Construction Code, and all relevant state and territory building regulations. We engage only licensed and insured tradespeople and maintain appropriate public liability and professional indemnity insurance coverage at all times.

3. Quotations and Pricing

All quotations provided by Elite Trade Management are valid for a period of thirty (30) days from the date of issue unless otherwise stated in writing. After this period, we reserve the right to revise the quotation to reflect any changes in material costs, labour rates, or other relevant factors.

Quoted prices are based on the information available to us at the time of quoting, including any site inspections conducted. Prices may vary if actual site conditions differ from those reasonably anticipated at the time of quotation. This includes, but is not limited to, the discovery of asbestos, structural defects, water damage, termite damage, or any other latent conditions that could not have been reasonably identified during the initial assessment.

All quoted prices are in Australian Dollars and are inclusive of GST unless expressly stated otherwise. We will provide itemised quotes wherever practicable to ensure full transparency on pricing.

4. Payment Terms

Payment terms will be outlined in the quotation or contract for each project. Unless otherwise agreed in writing, the following standard payment schedule applies:

  • A deposit of up to 10% of the total contract value (or as permitted under applicable state legislation) is required upon acceptance of the quotation to secure the project in our schedule.
  • Progress payments will be invoiced at agreed milestones throughout the project, corresponding to the completion of defined stages of work.
  • The final payment is due upon practical completion of the agreed scope of work and prior to final handover.

All invoices are due for payment within fourteen (14) days of the invoice date unless alternative terms are agreed in writing. Late payments may attract interest at a rate of 2% per month on the outstanding balance. Elite Trade Management reserves the right to suspend work if payments are not received in accordance with the agreed schedule.

5. Project Variations

Any changes to the agreed scope of work constitute a variation. All variations must be agreed upon in writing by both parties before any additional work commences. Elite Trade Management will provide a written variation notice detailing the additional or amended scope, any impact on the project timeline, and the cost associated with the variation.

Verbal instructions or requests for changes that are not confirmed in writing will not be treated as formal variations. We strongly encourage all communication regarding changes to be made in writing (including via email) to avoid misunderstandings and ensure all parties are aligned.

Where unforeseen conditions arise during the course of works that necessitate a change in scope, Elite Trade Management will notify the Client as soon as practicable, provide a cost estimate for the additional work, and seek written approval before proceeding.

6. Warranties and Guarantees

Elite Trade Management warrants that all work will be performed in a professional and workmanlike manner, using materials of suitable quality for their intended purpose. We stand behind our workmanship and offer a defects liability period as outlined in your project contract.

Where manufacturer warranties apply to products and materials used in your project, those warranties will be passed through to you. Elite Trade Management does not provide any additional warranties beyond those offered by the manufacturer for such products.

Warranties do not cover defects or damage arising from misuse, lack of reasonable maintenance, unauthorised alterations or repairs carried out by others, normal wear and tear, or damage caused by events beyond our reasonable control, including natural disasters, severe weather events, or third-party interference.

7. Limitation of Liability

To the fullest extent permitted by law, Elite Trade Management's total liability to the Client for any claim arising out of or in connection with the services provided shall not exceed the total contract value paid by the Client for the specific project giving rise to the claim.

Elite Trade Management shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profit, loss of revenue, loss of use, or loss of opportunity, arising out of or in connection with the performance of our services, regardless of whether such damages were foreseeable or whether we were advised of the possibility of such damages.

Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law or any other applicable legislation that cannot be excluded, restricted, or modified by agreement.

8. Cancellation Policy

If the Client wishes to cancel a project after acceptance of the quotation, the following terms apply:

  • Cancellations made more than fourteen (14) days before the scheduled commencement date will incur an administrative fee of 5% of the total contract value or the deposit amount, whichever is lesser.
  • Cancellations made within fourteen (14) days of the scheduled commencement date will result in forfeiture of the deposit, plus reimbursement of any costs already incurred by Elite Trade Management in preparation for the project, including materials ordered, permits obtained, and sub-contractor commitments.
  • Cancellations made after work has commenced will require payment for all work completed to date, materials procured, and any reasonable costs associated with demobilisation.

Elite Trade Management reserves the right to terminate a project at any time if the Client fails to meet their payment obligations, if access to the site is unreasonably withheld, or if conditions arise that make it unsafe or impracticable to continue work.

9. Intellectual Property

All designs, plans, drawings, specifications, and other documentation prepared by Elite Trade Management in connection with a project remain the intellectual property of Elite Trade Management unless expressly agreed otherwise in writing. The Client is granted a non-exclusive, non-transferable licence to use such documentation solely for the purpose of the specific project for which it was created.

The Client shall not reproduce, distribute, or use any of Elite Trade Management's intellectual property for any purpose other than the agreed project without our prior written consent. This includes the use of our documentation for obtaining competitive quotations from other providers.

10. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the State of Victoria, Australia. Both parties submit to the exclusive jurisdiction of the courts of Victoria and any courts competent to hear appeals from those courts.

If any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable, that provision shall be severed from the remaining terms, which shall continue to be valid and enforceable to the fullest extent permitted by law.
